Since the Spring of 2015 the quality of life for residents of DC communities along the Potomac River has been significantly reduced by a dramatic increase in aircraft noise. This increase in noise pollution was caused by the FAA shifting the northern flight path from Reagan Washington National Airport towards DC. It was implemented by the FAA without any notice to our communities and without the required environmental review. Not only is this increase in aircraft noise interrupting sleep and conversation, it is reducing the value of the houses impacted by the new flight path.
The civic associations representing Georgetown, Burleith, Foggy Bottom, Foxhall, Colony Hill, Palisades joined by Georgetown University formed the DC Fair Skies Coalition to fight this illegal action and filed an appeal with the Federal Court of Appeals for the District of Columbia Circuit challenging the drastic change in the flight paths as unlawful. Our volunteer attorneys have spent many months researching and drafting an opening brief and it needs to filed in January. This lawsuit is our only way of fighting the FAA. However, appeals are marathons not sprints and we cannot continue the fight without additional funding. We estimate that we will need at least $60,000 to complete the briefing, printing and filing of the required legal briefs and an extensive record and arguing the case before the Court. We need your help to raise the funds to permit our Court appeal to continue. If we miss this deadline we will have no other way to fight the increase in aircraft noise.
The primary objective of our appeal is to require the FAA to do a full "environmental assessment" before making any flight path changes and, in the case of the most recent change, requiring the FAA to return to the former flight path while it undertakes the necessary assessment. In support of our fight, the Mayor and the DC Council have budgeted funds to hire experts to conduct an aircraft noise study to be submitted to the FAA as part of a Court ordered environmental review. But we must first win our appeal in order to properly employ the funds for the noise study that the D.C. Government has authorized.
